Dispute Resolution
Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules (collectively, the "AAA Rules") then in effect, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be held in Miami-Dade County, Florida. The arbitrator shall have the authority to grant motions dispositive of all or part of any claim. The arbitrator shall have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the AAA Rules, and this Agreement. The arbitrator shall issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded.
Refunds
When you use Zinc’s services for a deposit transaction or transactions, and the deposit is ultimately refunded, we will attempt to refund the money or credit to the original payment method you used for the transaction. If we are unable to do so, the money will be waiting for you to claim by using one of the transfer methods available to Zinc, including check, ACH, or wire transfer.
